This Privacy Policy describes how Appmaking LTD, a legal entity incorporated in accordance with the laws of the Republic of Cyprus ("we", "us" or "our"), collects, uses, stores, transfers and discloses personal information from our Users in connection with our Services. One way to protect your privacy is to learn how personal information will be used before you give it out. We attach great importance to your privacy rights and truthfully explain why and how we use your information.
For the purposes of the General Data Protection Regulation 2016/679 and any implementing legislation (the "GDPR"), Appmaking LTD is the data controller responsible for any personal data we process.
In this Privacy Policy, the following definitions are used: "Services" refers to our Apps, Websites, and any related services or properties we control; "Apps" refers to applications and other products produced by us on any and all platforms; "Websites" refers to websites and other online properties we control, including appmaking.app; "Personal Data" refers to personal data that relates to you as an identified or identifiable individual; "Anonymous Data" refers to data from which your identity has been removed; "User" or "consumer" is any third party that uses our Services.
We have the right to update this Privacy Policy from time to time, so please be sure to check it regularly. We will notify you of any material changes by posting the new Privacy Policy on the primary access points to the Services or as otherwise required by applicable law.
Please read this Policy carefully and do not hesitate to contact us if you have any questions at appmaking@support-team.app. Where applicable, if you do not provide us with the relevant Personal Data, you may not be able to use our Services fully. You should not use the Services if you do not agree with this Policy or our Terms of Use.

2.1. When you use our Services, we may collect, use, receive, process, transfer and share some of your Personal Data for different legitimate purposes. Below you will find explanations of what Personal Data we may collect, the reasons why we may collect it and the legal bases relied on in each case. Please note that the types of information we may collect depend on how you use the Services.

2.2. Our Services allow in-app purchases. In-app purchases are not mandatory, and it is up to you whether to pay for such functionality. We do not process payments directly: payments are processed via the Apple App Store (https://www.apple.com/legal/privacy/en-ww/) and Google Play (https://policies.google.com/privacy) through the payment system integrated into the app store appropriate for your platform. If you purchase directly through our Website, payments may be processed by third-party payment processors [confirm and list: e.g., Solidgate, Stripe, PayPal]. We may receive billing and payment information that you provide when your purchase is processed by such third parties. Our third-party payment processors collect the billing and financial information they need to process your charges; this may include your postal address, e-mail address and financial information. We do not collect or store payment card data or payment-related credentials. However, our payment processors may share information with us related to your purchases, and we may use this information for the purposes described in this Privacy Policy.
2.3. The App requires your permission to access your microphone and your photo and video library when you use voice commands, when you upload photos for features described in Section 2.4, and when you share your achievements on your social media accounts. We access such content only to the extent needed to provide the relevant feature; we do not access your library beyond the items you select.
2.4. Styling features. If you use styling features, we make personalized recommendations of clothes (or provide advice on whether items match your style and fit your wardrobe) and ready-to-wear outfits by analyzing a photo of your face (complexion and shape of facial features), as well as your figure type, height and other parameters you provide. We also make recommendations of clothes that can help visually correct your figure. To use this feature, you can upload photos of items you own, and the application will generate outfits incorporating them.
2.5. No biometric identification. Photos and other data you provide (including photos of your face, arm or figure) are processed solely for the purpose of providing you with the requested features of the Service. We do not use your photos or any data derived from them to identify you or any other person; we do not use facial recognition technologies; and we do not create, collect or store biometric identifiers or biometric templates within the meaning of Article 9 of the GDPR or applicable US state privacy and biometric laws. We do not use your photos for marketing or advertising purposes, and we do not sell them or share them with third parties for their own purposes. Uploaded photos are retained only for as long as necessary to provide the relevant feature and are then deleted [confirm the exact retention period and whether processing is performed on-device or server-side, and state it here].
2.5. We may anonymize your Personal Data (so that it can no longer be associated with you) for research or statistical purposes. In such cases we may use anonymous information without further notice to you, since such information is no longer considered Personal Data and cannot be connected with you.
We collect the User’s Personal Data when the User starts using our Services and use it, for example, in the following ways:

Interest-based (behavioural) advertising. We may use automatically processed information for marketing purposes (to show ads that may be of interest to you based on your preferences). To make choices about interest-based ads from participating third parties, including opting out of behaviorally targeted advertising, please visit the Digital Advertising Alliance or Network Advertising Initiative consumer opt-out pages at http://www.networkadvertising.org/choices/ or http://www.aboutads.info/choices. Apple App Store Server API. To enhance subscription management and track user engagement, we integrate with Apple’s App Store Server API, including the consumptionRequestReason feature, which gathers data on how you interact with subscription content. Apple processes and safeguards this data under its Privacy Policy, retaining it only as needed to fulfil its intended purpose (for example, enabling a more efficient review of refund requests). Apple may share this data with authorized service providers as directed by you, but will not use it for marketing purposes. If you prefer not to share this event data with Apple, you can opt out by contacting us.
AI features. Our Apps include AI technologies designed to function as a personal expert. If you choose to interact with the expert, your conversations will be transmitted to OpenAI’s servers through an API connection. We do not share any data that would allow OpenAI to personally identify you, unless you voluntarily disclose such information during the conversation. We do provide your nickname to OpenAI so that the AI expert can address you correctly. OpenAI is not permitted to use your data for training or improving its models. Please be mindful that information you share in conversations may be sensitive; we advise against providing sensitive details, and we will not process such data unless we obtain your explicit consent — and if processed, only for the purpose of delivering our service to you. All data exchanged between our platform and OpenAI is transmitted via a SOC 2 Type 2 compliant API connection. OpenAI retains information transmitted via the API for a maximum of thirty (30) days, after which it is permanently deleted unless legal requirements mandate its retention. We may share your information with third-party companies to perform certain services, including, but not limited to, hosting, payment processing, analytics, customer service and marketing assistance. We share your Personal Data with certain third parties as part of our operation of the Service, whether shared by us or gathered directly by third parties through SDKs integrated into the Service. We undertake not to disclose or transfer the User’s Personal Data to any third parties, except the Processors mentioned in this Section, without the User’s personal consent. We will keep your Personal Data for the length of time required to provide you with the Service and for the reasons described in this Privacy Policy, unless a longer retention period is required or permitted by law. Afterwards, we delete all such data in our possession within a reasonable timeframe. We do not verify the correctness of Personal Data that we collect or that you provide. In all cases, Appmaking LTD does not retain such data for more than five (5) years. If you no longer want us to use your information, you can request that we erase your Personal Data and close your account. Except where a legal obligation sets a longer data retention period, at the end of these periods the processed Personal Data will be deleted or anonymized.
6.1. Personal Data may be processed by both automated and non-automated means and may be stored at our premises and on our service providers’ servers. We understand that, unfortunately, the transmission of information via the internet is not completely secure. We do our best to maintain the privacy and integrity of your information. We have implemented industry-standard security measures, including encryption, to protect your Personal Data, including information you input or share in the Services, and this information is not available to third parties except as described in this Privacy Policy. However, transmissions over the internet are never 100% secure, and you should not provide any Personal Data if you want to avoid any risk.
6.2. If any App integrates Apple HealthKit or Google Fit / Health Connect, state it here explicitly, including the categories of health data accessed. We will not use information received through the HealthKit or Google Fit frameworks for advertising or similar services, nor sell it. If no App uses these frameworks, delete this clause.
6.3. We operate internationally and provide our Services to Users around the world. We and the third-party organizations that provide automatic data processing technologies for the Services may transfer the automatically processed information across borders from your country or jurisdiction to other countries or jurisdictions around the world. Our servers are located in the European Union (Cyprus and Germany). Where your Personal Data is transferred outside the European Economic Area — for example, to processors in the United States listed in Section 4 — we rely on appropriate safeguards in accordance with Chapter V of the GDPR, such as the European Commission’s Standard Contractual Clauses and, where the recipient is certified, the EU-U.S. Data Privacy Framework. You may request further information about the safeguards applied to a specific transfer by contacting us at appmaking@support-team.app.
6.4. Cookies on the Website. The Website (appmaking.app) uses cookies and similar technologies: (a) strictly necessary cookies required for the operation of the Website; (b) analytics cookies that help us understand how visitors use the Website; and (c) marketing cookies, if any, used to measure the effectiveness of our campaigns. Where required by applicable law, non-essential cookies are set only after you give your consent via the cookie banner, and you can withdraw or adjust your consent at any time via the cookie settings on the Website or your browser settings. We attach great importance to Users’ privacy and would like to explain your data protection rights:
(i) The right to withdraw consent. If we process your data based on your consent, you have the right to withdraw your consent at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal. Withdrawal is made by simple notification to us via our support service, i.e., by emailing appmaking@support-team.app with the subject «Consent withdrawal», or in the Settings menu of the application.
(ii) The right to be informed. You have the right to know what Personal Data we hold and how and why we handle it. You can ask us for a copy of your Personal Data. If you would like to exercise your right of access, please contact us as described below and let us know what information you would like to receive.
(iii) The right to opt out of interest-based advertising in mobile applications by adjusting the privacy settings of your device. Please note that even if you opt out, you will still receive advertising, but it will not be targeted at your interests. On iOS, you can control tracking under Settings → Privacy & Security → Tracking (App Tracking Transparency): disable «Allow Apps to Request to Track» or deny tracking for individual apps. On Android, go to Settings → Google → Ads (or Settings → Privacy → Ads) and delete or reset your advertising ID and opt out of ads personalization.
(iv) The right to rectification. You have the right to request an update or correction of any of your Personal Data that is out of date, incomplete or incorrect (Article 16 of the GDPR).
(v) The right to erasure («right to be forgotten»). You have the right to request that we delete certain of your Personal Data. There are situations where we are unable to delete your data, for example when: it is still necessary to process the data for the purpose for which it was collected; our interest in using the data overrides your interest in having it deleted (for instance, we need the data to protect the Service from fraud); or we have a legal obligation to keep the data, or require the data to establish, exercise or defend legal claims.
(vi) The right to object. You have the right to object to our processing of your Personal Data under certain conditions: where we process your Personal Data on the legal basis of legitimate interest, or where we process it for interest-based advertising. You may object at any time on grounds relating to your particular situation, and you may object at any time to your Personal Data being processed for direct marketing purposes.
(vii) The right to restrict processing under the conditions set out in Article 18 of the GDPR or other applicable laws of your country of residence. You can do this if: your Personal Data is inaccurate; our processing is unlawful; we no longer need your information for a specific purpose; or you have objected to processing and we are assessing your objection.
(viii) The right to data portability. In some circumstances, you may have the right to request that the data you provided to us be given to you in a structured, commonly used and machine-readable format so that you can transfer it to another data controller. Requests can be sent to appmaking@support-team.app.
(ix) The right to complain to a data protection authority about our collection and use of your Personal Data. We would appreciate the chance to address your concerns directly, so please consider contacting us first; nevertheless, you can complain to a competent supervisory authority, in particular in the EU Member State where you reside, work or where the alleged infringement occurred. (x) The right of access. You have the right to request access to the Personal Data we collect from you, to change it, or to delete it in some circumstances, and to ask for copies of your Personal Data. One copy of the Personal Data undergoing processing is provided free of charge; additional copies may be subject to a reasonable fee. To submit a request, please email appmaking@support-team.app. We will respond to your request within one (1) month of receipt.
Our Services have a minimum age requirement and are not directed at children, and we do not knowingly collect Personal Data relating to children. Children should never disclose their name, address, phone number or any personal information without their parents’ prior permission. We consider a user to be a child if they are under the age of 13, unless more stringent regulation applies in their country of residence. In EU countries, users under the age of 16 are considered children, unless the data protection regulation of their country of residence specifies another age. If you become aware that your child has provided us with personal information without your consent, please contact us, and we will take the required steps to delete such information. Moreover, some of the Apps are limited to users who are 18 or older.
This Section provides additional information about how we collect, use, disclose and otherwise process personal information of individual residents of the State of California within the scope of the California Consumer Privacy Act of 2018 as amended by the California Privacy Rights Act of 2020 (together, the "CCPA"). Terms defined in the CCPA have the same meaning when used in this Section.
California law requires us to disclose the categories of personal information we collect and how we use them, the categories of sources from which we collect personal information, and the third parties with whom we share or to whom we disclose personal information. Detailed descriptions are provided above in this Policy. In particular, our Services have collected the following categories of personal information from consumers within the last twelve (12) months:

We do not rent or sell personal information for monetary consideration. We do share personal information with the Processors listed in Section 4. As a California resident, you have the following rights: the right to know (request information about how we have collected and used your personal information during the past 12 months); the right to request a copy of the personal information collected about you during the past 12 months; the right to request deletion of the personal information we have collected from you (if you ask us to delete some or all of your information, you may no longer be able to use the Services); the right to correct inaccurate personal information; the right to opt out of the sale or sharing of personal information; the right to limit the use and disclosure of sensitive personal information, where applicable; and the right to be free from discrimination for exercising your rights.
Under California’s «Shine the Light» law (Civil Code § 1798.83), California residents may request, once a year and free of charge, a list of the third parties to whom we have disclosed their personal information (if any) for their direct marketing purposes in the prior calendar year. We do not disclose personal information to non-affiliated companies for their direct marketing purposes without your permission.
You may exercise your California privacy rights by emailing us at appmaking@support-team.app. We will need to confirm your identity (e.g., first name, last name, account name, email address, state of residence) and California residency to process your request. We aim to respond to a consumer request for access or deletion within forty-five (45) days of receiving it. If we require more time, we will inform you of the reason and the extension period in writing.
